Warranty:
Kinfolk Crafts provides web design services for the Artisan desiring to sell their creations online. All products are ordered and shipped directly from the artisan and we are not involved in the actual transaction. Unless specifically noted, Kinfolk Crafts does not warrant or guarantee the quality, safety or legality of the items advertised, or the ability of the Supplier to sell the products made available through Kinfolk Crafts.

Limitation of Liability:
Generally, you expressly acknowledge and agree that use of the Kinfolk Crafts web site and the Internet is at your own risk. Kinfolk Crafts shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from, or relating in any manner to the use of the Kinfolk Crafts web site to purchase products. In the event that you have a dispute with one or more Artisans, you release Kinfolk Crafts (our officers, directors, agents, and employees) from claims, demands and damages (actual and consequential) of every kind and nature. Some jurisdictions do not allow the exclusion or limitation of warranties or incidental or consequential damages, so the above limitations or exclusions may not apply to you.

Indemnification:
You agree to indemnify, and hold Kinfolk Crafts, its affiliates, agents, officers, directors, employees, successors and assigns harmless from any and all claims, liabilities, damages, costs and expenses (including, but not limited to, consequential damages, incidental damages, special damages, attorney’s fees and disbursements) arising from the use of the Kinfolk Crafts web site.

Governing Law:
The laws of the State of Missouri shall govern this Agreement. Any dispute concerning this Agreement, or any matter related in any manner to this Agreement, shall be subject to the exclusive jurisdiction of the courts of the State of Missouri located in Cape Girardeau County, Missouri. This Terms of Use Agreement, together with any additional online documents, is the entire Agreement between Kinfolk Crafts and you and supersedes any other communications or advertising with respect to Kinfolk Crafts. If any provision of this Agreement is determined to be unenforceable or contrary to law in a court of competent jurisdiction, the remaining provisions shall remain valid and in effect, and shall be construed so as to give full effect to the intentions of the parties.
